PLEASE CHECK CAREFULLY as no claims for shortages or damage will be allowed after 24 hours of delivery and returned goods will not be allowed after 45 days of delivery. Restock fees will be assessed on returned goods. These materials are furnished for and are to be used in and upon the premises described above. For jobsite deliveries, Washington Cedar & Supply Co. Inc. shall not be liable for damage due to structurally unsound roof substrates or unstable soil condition and, customer shall indemnify and hold Washington Cedar harmless for such claims. HOMEOWNER ASSUMES FULL RESPONSIBILITY FOR ANY LOSS OR PROPERTY DAMAGE, that may be sustained by the delivery of materials to the homesite by Washington Cedar & Supply (WCS). Homeowner hereby RELEASES, WAIVES, DISCHARGES, AND COVENANT NOT TO SUE, WCS or their employees from any and all liability, claims, demands, actions and causes of action whatsoever arising out of or related to any loss or damage, that may be sustained by Homeowner, or to any property belonging to Homeowner. The property owner and or contractor on behalf of the property owner acknowledges and agrees, by scheduling jobsite delivery of materials offered by (WCS) that (WCS) will not be held responsible for any damage, to pavement, asphalt, dirt/gravel, subgrades, curbing, driveways, sidewalks, parking areas, pipes, drains, water lines, walls, fencing, gates, and or any other property related to access, and any other unseen structure. Whether scheduled by property owner or by contractor, property owner agrees to hold WCS harmless for any and all damages, now and future, that may result from delivery and/or pickup of scheduled project when utilizing access necessary to perform the services requested. Due to manufacturer’s volatile market conditions, PRICES SUBJECT TO CHANGE WITHOUT NOTICE.

TERMS: IF IT BECOMES NECESSARY TO INSTIGATE COLLECTION PROCEDURES, COLLECTION COSTS, ATTORNEY FEES, COURT COSTS AND/OR RELATED DAMAGES AND COST WILL BE ASSESSED, ALL CLAIMS AND RETURNED GOODS MUST BE ACCOMPANIED BY THIS BILL. LIABILITY LIMITED TO MATERIALS AMOUNT PURCHASED. SCHEDULED LOADS RETURNED UNDELIVERED WILL BE ASSESSED A HAUL CHARGE. A $25.00 HANDLING FEE WILL BE ASSESSED ON EACH RETURNED CHECK. ORAL AGREEMENTS OR ORAL COMMITMENTS TO LOAN MONEY, EXTEND CREDIT, OR TO FORBEAR FROM ENFORCING PAYMENTS OF DEBT ARE NOT ENFORCEABLE UNDER WASHINGTON LAW.

LIMITED WARRANTY: Where the manufacturer of any materials has provided a warranty, all such manufacturer’s warranties are hereby assigned to Purchaser as Purchaser’s sole remedy for any defect or failure of materials. In all other cases, Washington Cedar’s sole liability for any defect or failure of materials shall be, at Washington Cedar’s option, replacement of the defective materials or refund of the amount paid for the defective materials. THIS WARRANTY IS IN LIEU OF ALL OTHER WARRANTIES, EXPRESS OR IMPLIED, INCLUDING ANY WARRANTIES OF MERCHANTABILITY OR FITNESS FOR PARTICULAR PURPOSE. In no event will Washington Cedar be responsible for special, incidental, or consequential damages, the remedies herein being exclusive. WHEN PURCHASING WITH WASHINGTON CEDAR & SUPPY CO. INC, YOU AGREE TO ALL THE ABOVE TERMS AND CONDITIONS AND ARE A DULY AUTHORIZED AGENT OF THE ABOVE NAMED PURCHASER.
